Joshua H. Abramson Contributes Business Litigation Update to DRI Blog

Joshua H. Abramson, counsel to Porzio, Bromberg & Newman P.C. (“Porzio”), authored a blog post titled, New York Court of Appeals Firmly Narrows a Medical Corporation’s Fiduciary Liability for the Unauthorized Disclosure of Confidential Patient Information by a Non-Physician Employee, on the DRI Blog.

The article is focused on a recent New York Court of Appeals ruling in Doe v. Guthrie Clinic, that held “a medical corporation’s duty of safekeeping a patient’s confidential medical information is limited to those risks that are reasonably foreseeable and to actions within the scope of employment.” Mr. Abramson notes that the ruling has significance for medical corporations as it firmly restricts their fiduciary liability for an employee’s unauthorized disclosure of confidential patient information.
