Porzio Counsel Peter Gallagher Quoted in Article on New Jersey Consumer Law

Porzio Counsel Peter J. Gallagher was quoted in the New Jersey Law Journal article, "NJ Consumer Law Still Unsettled After Restaurant Patrons' Case Is Tossed," by Charles Toutant, on October 10, 2017. 

After a closely watched Truth in Consumer Contract, Warranty and Notice Act (TCCWNA) case, on October 4, 2017 the Supreme Court ruled in Dugan v. TGI Friday’s and Bozzi v. OSI Restaurant Partners that restaurant patrons cannot recover for the restaurants' failure to list alcoholic beverage prices on the menu, under the TCCWNA. The impact of this ruling on other pending TCCWNA cases is up for debate. 

According to Mr. Gallagher, the justices’ reference to a potential $1 billion penalty against TGI Friday’s was “an interesting approach." He added that the ruling “clarified the statute to a greater degree than we had before” and was “a good decision for companies that are troubled by TCCWNA.”

Mr. Gallagher is an accomplished litigator with experience representing clients in commercial disputes, and counseling clients on various issues in an effort to mitigate potential problems before they become the subject of litigation.
