The case involves complex issues regarding the alleged toxicity and epidemiology of the chemical compounds in issue, the mechanism by which they may have migrated from a manufacturing facility into a community groundwater source, the nature of plaintiffs’ exposure to the compounds, and the risks, if any, posed to the health of the plaintiffs.

Lead counsel to the world’s largest distributor of medical products in a nationwide price gouging case arising out of the sale of flu vaccine. We defeated the plaintiffs’ motion to compel disclosure of confidential customer lists, limited class-related discovery to one region of the country, and obtained a dismissal of the putative class. The trial court’s opinion in West Morris Pediatrics v. Henry Schein, Inc., 2004 N.J. Super LEXIS 493 (N.J. Law Div. 2004), is one of the few published class action decisions in New Jersey. We also prevailed in the Appellate Division when plaintiffs’ counsel sought to challenge the trial court’s grant of a modest fee award after we had settled the claims of the two denominated plaintiffs for a nominal amount.
Co-counsel and one of the first firms in the nation to actually try a medical-monitoring class action in a products liability case. Our work in the Vadino v. Wyeth diet drug case led to a nationwide settlement of these claims.
