Reductions in Force

Employers facing the need to reduce their workforces in order to meet their business goals face a series of difficult decisions that impact their company in multiple ways.  Porzio's team works with employers to provide legal and business counseling to help minimize the impact of a reduction in force and also manage the risk of related litigation.

Federal, state, and local laws and regulations regarding reductions in force are complex and failure to comply can lead to litigation. Employers who qualify must understand the federal WARN Act and the related notification requirements, and other laws including ERISA, COBRA, the Fair Labor Standards Acts, the National Labor Relations Act, and others relating to employee benefits, discrimination, and more. 

Many employers find themselves in the unfortunate position of having to conduct large-scale reductions in force.   We counsel clients on compliance with the law, including the Federal WARN Act as well as the New Jersey Millville Dallas Plant Job Loss Notification Act and the New York State Worker Adjustment and Retraining Notification Act.
