Overview
Erik Lascano helps businesses, creditors, trustees, and other stakeholders navigate complex commercial bankruptcy and financial restructuring matters. His practice includes Chapter 11 reorganizations and liquidations, creditors’ rights, bankruptcy litigation, and other insolvency proceedings. He represents clients across the bankruptcy process, including official committees of unsecured creditors, liquidating trustees, debtors, and secured creditors. Erik also handles bankruptcy litigation involving preference and other avoidance actions as well as adversary proceedings. His insolvency practice also extends to state court receivership proceedings, where he has assisted court-appointed receivers.
Before joining Porzio, Erik served as a law clerk to the Honorable Stanley L. Bergman Jr., Superior Court of New Jersey, Appellate Division, for the 2024–2025 term. There, he drafted opinions and bench memoranda on criminal, civil, chancery, and administrative appeals. Earlier, he interned for the Honorable Rosemary Gambardella (Ret.), United States Bankruptcy Court for the District of New Jersey. In that role, he worked on bankruptcy matters involving dischargeability, fraudulent transfer, and contested matters and observed bankruptcy proceedings under Chapters 7, 11, and 13. These experiences give him firsthand insight into how courts evaluate complex financial disputes, helping him approach bankruptcy and restructuring matters with both the client’s objectives and potential litigation considerations in mind.
Erik also focuses on emerging issues involving blockchain technology and digital assets, including their intersection with bankruptcy and financial restructuring. His research and writing have focused on the distinct questions digital assets can raise in insolvency proceedings, including issues of control, perfection, and priority under the Uniform Commercial Code. Through this work, he has gained experience examining the implications of emerging digital asset issues for debtors, creditors, and other stakeholders in bankruptcy and financial restructuring matters.
