Vito Gagliardi Interviewed on WCZT Radio Regarding Cape May Attempt To Block Ballot Question

Vito A. Gagliardi, Jr., a principal of Porzio, Bromberg & Newman, was interviewed on WCZT Radio The Coast, regarding the City of Cape May’s filing of an order to show cause to block an unlawful ballot question on the upcoming non-binding voter referendum on November 5, 2013. The question on the ballot is: “Whether the City of Cape May should be permitted to withdraw from the Lower Cape May Regional School District or, in the alternative, should the Lower Cape May Regional School District be dissolved.”

Counsel to Cape May, Mr. Gagliardi filed the complaint on October  15, 2013, seeking an order to require Cape May County Clerk, Rita Fulginiti, to remove the regional school board question and re-issue ballots in Lower Township, West Cape May and Cape May; or otherwise prevent voters from considering the unlawful question. At the hearing on October 24, the Court granted Cape May's application and issued an injunction which blocks votes on the question.
