Porzio Victory on Behalf of Fitbit Detailed in Law360 Article
Porzio Principal Michael L. Rich and co-counsel Zachary Alinder and Jeffrey Hallam of Sideman & Bancroft were successful in obtaining the dismissal of client Fitbit from the New Jersey USDC matter, Laguna 2 LLC v. Fitbit LLC. The victory was detailed in the May 10, 2017 Law360 article, "Stolen Fitbit Allegations Can’t Proceed In NJ, Judge Says," by Adam Rhodes.
The suit accused Fitbit of falsely claiming that a retailer of refurbished electronics was selling stolen items. On May 9, 2017, U.S. District Judge Madeline Cox Arleo freed Fitbit from the suit, ruling that although New Jersey retailer Laguna 2 LLC was allegedly harmed by false claims, that does not mean a New Jersey court has jurisdiction over the suit.
